BGinvo, the BGinvo logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BGinvo or its affiliates. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.

3. Products and Services

BGinvo provides invoicing, expense tracking, quote generation, and business management tools. Except as required by the Australian Consumer Law, BGinvo provides its products to you on an "as is" basis without any representations regarding the use, performance, or results of the products.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

4. Third Party Products and Services

Our website and products may contain access to, or features that interface with, third party products and online services. Where third party services are available:

• Separate terms and conditions with the third party provider may apply
• Additional charges may apply, including internet access costs
• Access to third party services may be withdrawn at any time
• BGinvo does not make any recommendations regarding third party services

Except as required by consumer guarantees, BGinvo does not accept any liability for loss or damage relating to third party products or services.

In particular, our optional receipt and document scanning feature uses Anthropic, a third-party artificial intelligence provider, to automatically extract details (such as merchant, date, amounts, and tax/GST) from documents you choose to scan. When you use this feature, the document you upload is sent to Anthropic for processing. Please see our Privacy Policy for details on how this information is handled.

5. No Financial or Professional Advice

Important: BGinvo does not provide financial, accounting, taxation, superannuation, or legal advice.

While our products may contain features designed to assist you in managing your business finances, you acknowledge that BGinvo is not engaged in rendering legal, accounting, or other professional services. Nothing in our products or website constitutes professional advice.

The information provided is not a substitute for obtaining appropriate independent professional advice. Legal, accounting, or other relevant professional advice should be obtained before taking any action in reliance on our products or services.

6. User Accounts and Security

Upon registration, you may be provided with confidential credentials including passwords, access codes, and account numbers. You are responsible for:

• Keeping these credentials confidential and secure
• Notifying us immediately if you become aware of any unauthorized access
• All activities that occur under your account
• Any charges or liability arising from sharing your credentials with others

7. Subscription and Payments

Some features of BGinvo require a paid subscription. You agree to pay all subscription, service, and user fees which may be levied by BGinvo. These charges may vary from time to time. By subscribing:

• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Payment: Payment will be charged to your chosen payment method at confirmation of purchase
• Free Trials: Any unused portion of a free trial period will be forfeited upon subscription purchase
• Price Changes: We may change subscription prices with reasonable notice

8. Cancellation and Refunds

You may cancel your subscription at any time:

• iOS Users: Settings → Apple ID → Subscriptions
• Android Users: Google Play Store → Menu → Subscriptions
• Web Users: Account settings or billing portal

Cancellation takes effect at the end of the current billing period. Refunds are handled according to the policies of your payment provider.

9. Data and Online Access

Except as required by the Australian Consumer Law, BGinvo disclaims all liability for:

• Corruption of data
• Inability to access data
• Loss of data
• Breach of privacy
• Downtime resulting from use of online services

Response times and the ability to complete online transactions vary with user demand. You agree not to hold BGinvo responsible for any inability to complete transactions due to high demand, to the extent permitted by law.

10. Confidentiality

While BGinvo uses best endeavours to ensure your information remains confidential, including advanced encryption technology, the internet is not completely secure. There remains a possibility that information you provide could be intercepted by unauthorized persons. By accessing our services, you accept this inherent risk.

11. Copyright and Intellectual Property

You agree not to infringe BGinvo's or any third party's copyright or other intellectual property rights in any material on the website or products. This includes:

• Not copying, downloading, re-transmitting, or disseminating copyrighted material (unless expressly permitted)
• Not infringing any trademark of BGinvo or third parties
• Not reverse engineering or attempting to extract source code

12. Links to Other Sites

Our website may contain links to other sites. BGinvo is not responsible for the content or information available on linked third party websites. The inclusion of any link does not imply endorsement by BGinvo. Content on linked sites is the sole responsibility of the relevant website operator.

13. Prohibited Uses

You agree not to use BGinvo for:

• Infringing upon the rights of others
• Submitting false, misleading, or fraudulent information
• Attempting to gain unauthorized access to our systems
• Interfering with the proper functioning of the service

We reserve the right to terminate your access for any violation of these terms.

14. Monitoring

Use of this site and our services may be monitored by BGinvo for security, quality control, and service improvement purposes.

15. Limitation of Liability

This clause is subject to the Australian Consumer Law and similar legislation.

In Australia, our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

To the extent permitted by law:

• BGinvo expressly excludes all implied warranties as to merchantability or fitness for particular purpose
• BGinvo shall not be liable for any indirect, incidental, special, consequential, or economic loss
• Our maximum liability is limited to providing the service again or paying for the service to be provided again
• Our total liability shall not exceed the amount you paid in the past twelve months

BGinvo, its employees, agents, contractors, and authors disclaim liability for any errors or omissions and for consequences of actions taken in reliance on our products or website content.

16. Governing Law and Jurisdiction

You agree that these Terms are governed by the laws applicable in the State of New South Wales, Australia. Any disputes arising from these terms or your use of the service shall be resolved in the courts of New South Wales, Australia.

17. Severability

If any provision of this Agreement is rendered void or unenforceable at law, then this Agreement is to be read as if that particular term or provision had not been included, and the remaining provisions shall continue in full force and effect.

18. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by posting the new Terms of Service and updating the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the new terms.
